The GOODFELLAS app services, available on smartphones and other digital platforms in several countries, are provided by GOODFELLAS (the “Platform”), owner of the intellectual property in the software, website, applications, content and other assets. The Platform is offered internationally; these Terms govern access and use by all users, without prejudice to rights guaranteed by each user’s applicable local law.
1. Definitions
- Platform: the app, admin panel, website and related services.
- User: any registered individual or entity (students, practitioners, instructors, teams, academies).
- Practitioner: a user who trains, challenges opponents and progresses in the sport.
- Challenge: a combat sports event (e.g., 1v1, 4v4) organized/mediated by the Platform.
- CBJJ / IBJJF: the Brazilian Jiu-Jitsu Confederation and the International Brazilian Jiu-Jitsu Federation, whose ranking/graduation rules are used as a reference.
- Automated assistant (bot): automated interaction, including via messaging apps.
- Location data: device geolocation, used by location-based features.
2. Purpose
The Platform licenses the use of the software and assets on a non-exclusive, non-transferable basis, as a social, location-based service for the jiu-jitsu community. Services include:
- intermediating classes/trainings between students and instructors, including paid ones;
- recording/confirming trainings (check-in), attendance, progress and graduation;
- organizing and mediating challenges and combat events;
- location-based features (nearby trainings, opponents, instructors and academies);
- managing subscribers, teams, credentialed instructors and academies;
- automated assistant, including via messaging apps;
- selling plans/subscriptions (including Premium), payments for trainings and challenges;
- APIs and developer interfaces and, in the future, third-party authentication/authorization (“Sign in with Goodfellas” / OAuth).
3. Acceptance
3.1. Acceptance is express, by affirmative action at signup (checkbox “I have read and agree to the Terms of Use and Privacy Policy”).
3.2. Continued access and use reaffirm agreement with the current version.
3.3. These rules are essential to use the Platform; anyone who disagrees must not register or use it.
4. User registration
4.1. Access requires prior registration with complete, truthful and up-to-date information, under the user’s responsibility.
4.2. Login and password are personal and non-transferable; the user is responsible for all account activity and must promptly report any misuse.
4.3. Registration is single-person and non-transferable, except for teams and academies; assigning, selling, subleasing or transferring is prohibited.
4.4. The user may cancel at any time, handled as soon as possible, save for pending items, debts and data retention required by law.
5. Access to the Platform
5.1. GOODFELLAS will use reasonable technical means for continuous access, except for force majeure, fortuitous events and third-party failures.
5.2. Access may be suspended, limited or modified for maintenance/correction, with notice when feasible.
5.3. The user must keep compatible equipment/connection and adopt security measures in their own environment.
6. Plans, prices, payments and cancellation
6.1. There are free and paid services (Premium, payments for trainings, academy/team subscriptions, challenge fees), as informed at purchase.
6.2. Prices may change upon prior notice; the prices in force at the time of the order apply, in local currency, varying by country and taxes.
6.3. Payments may be processed by payment providers and app stores. Financial data may be stored for future purchases, per the Privacy Policy.
6.4. Subscriptions may auto-renew per the chosen payment method until the user cancels.
6.5. Cancellation may be requested at any time. The right of withdrawal follows local law (e.g., 7 days in Brazil, art. 49 CDC; 14 days in the EU), subject to exceptions for digital content already supplied.
7. Services, products and support
7.1. Services are described as accurately as possible (features, quantity, price, warranty, terms).
7.2. Complaints and issues should be sent to support, answered within 2 business days.
8. Conduct and acceptable use
The user acts in good faith and in accordance with the law. It is prohibited to:
- post unlawful, offensive, discriminatory, pornographic, xenophobic content, violence outside the sporting context, or content that infringes third-party rights;
- insert links/pages for unauthorized advertising/commercial purposes;
- harass, threaten or intimidate other users;
- compromise security, bypass access controls or deliberately overload the infrastructure;
- create a false identity, use third-party data, or falsify training, graduation, location or challenge information.
9. General conduct — jiu-jitsu etiquette and rules
9.1. Practitioners follow ethics and morality, abiding by CBJJ rules (and IBJJF internationally), including hierarchy and graduation.
9.2. Etiquette and mat conduct duties, among others:
- protect the image and integrity of oneself and one’s team;
- ask the instructor for permission to enter/leave the mat and bow in order of graduation;
- follow the instructor’s guidance and not talk during technique explanations;
- keep personal and gear hygiene (gi/rashguard) and nails trimmed;
- protect training partners’ physical integrity during rolls, avoiding shouting/taunts;
- no phone during training; no shoes/socks, food or gum on the mat; be punctual;
- do not remove gi/belt before class ends; keep proper posture;
- lower ranks do not invite higher ranks without the instructor’s consent;
- loyalty to team/instructor/lineage; changing teams requires the instructor’s approval or, failing that, the higher ranks’;
- compete only with the instructor’s express authorization.
9.3. Image rights on the mat: do not record/photograph colleagues without prior express authorization, nor share such media without consent.
9.4. Before training, the practitioner provides accurate data: full name (and social name, if applicable), tax ID (CPF/CNPJ), profile photo, gender, age, email, address and, when available, graduation certificates.
9.5. Challenges and matchmaking. Training and classes between users of different genders are unrestricted, as is customary in the sport. In competitive challenges, matchmaking follows safety criteria — typically belt/graduation, weight category and, where applicable, gender — analogous to the CBJJ/IBJJF category system, to avoid mismatches that raise injury risk. The parties may adjust the challenge parameters by mutual agreement. Participation by anyone other than the registered person is prohibited.
9.6. Challenge setup: the host provides the structure (mat); combat time and format are agreed in advance between the parties.
9.7. Paid training: a subscriber who sells a training must deliver it within 15 calendar days of acceptance, with details agreed between the parties.
10. Copyright and trademark
10.1. These Terms grant a non-exclusive, non-transferable license to use the application; sublicensing is prohibited.
10.2. The structure, the GOODFELLAS trademark, trade name, layouts, design, videos, content, database and other assets are the exclusive IP of GOODFELLAS; these Terms do not assign such rights, except the limited license.
10.3. The user retains ownership of the content they submit (photos, videos, texts) and grants a non-exclusive, free license, for as long as needed to provide the services, to store/display/process it solely for the Platform’s purposes. Misuse of the trademark is subject to legal penalties.
11. Minors
11.1. The sport often involves children and teenagers; registration/use by minors requires the consent and supervision of at least one parent or legal guardian.
11.2. The minimum age to consent without assistance varies by country (generally 16 in the EU, 13 under COPPA in the US, 18 for full civil capacity in Brazil). The minor’s jurisdiction rule applies, in their best interest.
12. Disclaimer, assumption of risk and limitation of liability
12.1. Intermediary nature. GOODFELLAS is a technology platform that merely connects users. It does not teach classes, organize, run, supervise or referee in-person trainings and challenges, is not a party to the relationship between users, and does not guarantee the conduct, qualification, graduation, integrity, safety or truthfulness of information provided. Disputes are resolved directly between the users.
12.2. Assumption of risk. Jiu-jitsu is a contact/combat sport with an inherent risk of injury, including serious injury. By using the Platform, training, rolling or taking part in challenges (via the app or in person), the user acknowledges and voluntarily and fully assumes those risks, being responsible for assessing their health condition and obtaining medical clearance where applicable.
12.3. Release. To the maximum extent permitted by law, the user releases GOODFELLAS, its affiliates, partners, officers and staff from liability for damages, injury, death, losses arising from the sporting activity, trainings, rolls and challenges, from the conduct of other users/instructors/teams/academies, and from the use or inability to use the Platform.
12.4. "As is" service. The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, of fitness, uninterrupted availability, error-free operation or results, to the maximum extent permitted by law.
12.5. Content and third parties. GOODFELLAS is not liable for user content/media, third-party links and services, or interruptions and technical failures beyond its control.
12.6. Exclusion of damages. To the maximum extent permitted by law, GOODFELLAS is not liable for indirect, incidental, consequential, special or punitive damages, lost profits, loss of data, revenue or opportunity.
12.7. Liability cap. Where liability cannot be excluded, GOODFELLAS’s total aggregate liability is limited to the greater of (i) the total the user paid GOODFELLAS in the 12 months before the event and (ii) BRL 100 or the local-currency equivalent.
12.8. User indemnification. The user will defend, indemnify and hold GOODFELLAS harmless from third-party claims, losses and expenses (including fees) arising from their use, content or conduct, or breach of these Terms, the law or third-party rights.
12.9. Force majeure. GOODFELLAS is not liable for failures or delays due to events beyond its reasonable control (fortuitous events, force majeure, network/power/vendor/app-store failures).
12.10. Rights that cannot be excluded by law. Nothing herein excludes or limits liability that applicable law does not allow to be excluded or limited — willful misconduct, fraud, gross negligence, death or personal injury caused by negligence, and consumer rights under mandatory rules (e.g., the CDC in Brazil, EU consumer law). In such cases, liability is the minimum required by law.
13. Penalties, suspension and termination
13.1. Without prejudice to administrative, civil and criminal measures, GOODFELLAS may warn, suspend or cancel the account for breach, non-compliance, fraudulent/malicious/offensive conduct, or breach of the expected sporting conduct.
13.2. Breach of these Terms or the law may lead to termination and blocking/cancellation of subscriptions and information, save for record retention required by law.
14. Personal data protection
14.1. Processing follows the LGPD (Law 13.709/2018) and, depending on the user’s location, the GDPR (EU), the UK GDPR and other local laws, as described in the Privacy Policy, an integral part of these Terms.
15. Automated access, APIs and developers
15.1. GOODFELLAS takes an open stance: automated access and collection of public content and non-personal data are permitted, including scraping and via the APIs, subject to this section’s limits.
15.2. GOODFELLAS offers or intends to offer APIs, developer interfaces and, in the future, third-party authentication/authorization (OAuth), which may be governed by specific developer terms.
15.3. In return, users and developers agree to: (i) not collect/extract/redistribute other users’ personal data contrary to the Privacy Policy and data-protection law; (ii) not degrade or compromise stability/security, respecting rate limits; (iii) not use access for unlawful purposes or to infringe third-party rights.
15.4. Opening data/APIs does not transfer IP in the software or trademark and may be changed, limited or revoked at any time to protect users, security or compliance.
16. International users and governing law
16.1. The Platform operates in several countries; the user must comply with the local law applicable to their access and use.
16.2. These Terms are governed by the laws of Brazil, without depriving consumers of the protection of mandatory rules of their country of habitual residence.
16.3. In case of conflict between translations, the Brazilian Portuguese version prevails, except where local law requires the user’s language.
17. Changes
17.1. These Terms may change at any time to adapt the service or for legislative changes, notified in the app and by the registered email; if the user does not accept, they may cancel the service.
18. General provisions and jurisdiction
18.1. Tolerance of any breach implies no waiver or novation; invalidity of one provision does not affect the others.
18.2. The courts of Guarulhos/SP, Brazil, are elected, without prejudice to the consumer’s right to sue in their own domicile where local law so guarantees.
